Each Plan Year Flex Administrators provides you with an opportunity to test your Flexible Spending Account (FSA) Plan for compliance.  The information we need from you to test your Plan can be sent anytime during the Plan Year.  If you decide not to return the requested information, we will be unable to test and ensure compliance of your FSA Plan.

The Internal Revenue Code contains several nondiscrimination rules for flexible benefit plans. These rules are intended to ensure that flexible benefit plans do not discriminate in favor of highly compensated individuals. While many of the rules are satisfied by the design of your flexible benefit plan, there are some numerical tests that should be performed for you. Flex Administrators will perform these tests for you. 

Please follow the steps below to complete the testing template and then return it to us at your earliest convenience. The tests needs to be run prior to the end of the Plan Year. 

Step 1

Please read the information regarding the required fields and definitions. PLEASE ONLY INCLUDE EMPLOYEES CURRENTLY ENROLLED IN THE PLAN.

Step 2

Complete the Spreadsheet with information regarding employees currently enrolled in the FSA Plan

Step 3

Send the completed spreadsheet securely to Flex Administrators, Inc. for testing.

The file can be sent by secure email to: service@flexadministrators.com with a subject line of Non-Discrimination Testing for (Include Name of Employer) or the file can be uploaded to us securely through our SECURE FILE UPLOAD option.

Once we have completed the testing we will respond to our main contact at the group with the results of the tests. Please allow up to 2 weeks for testing results to be sent.
